Terms of Service

1. Acceptance of terms

By creating an account and using PerkPing, you agree to these Terms of Service on behalf of your organisation. If you do not agree, do not use the service.

2. The service

PerkPing provides an automated employee benefits platform that facilitates the delivery of monthly digital gift cards to employees under the HMRC trivial benefits exemption (Section 323A ITEPA 2003). We do not provide tax advice. You remain responsible for ensuring your use of the service complies with applicable tax law. We recommend consulting your accountant.

3. Accounts and access

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You must be authorised to enter into agreements on behalf of your organisation.
• One account per organisation. You may invite multiple administrators.

4. Billing and payments

By setting up a GoCardless Direct Debit mandate, you authorise PerkPing to collect £25 per active employee per month on the 1st of each month. Charges are calculated based on the number of active staff at the time of the billing run.

If a payment fails, PerkPing will notify you by email. Unfulfilled gift card orders as a result of payment failure will not be retried automatically.

You may cancel your subscription at any time. Cancellation takes effect from the next billing cycle. No refunds are issued for the current billing month.

5. Gift card delivery

Digital gift cards are sourced from Reloadly and delivered by email. Once a gift card has been sent to an employee, it cannot be recalled or refunded. PerkPing is not responsible for how employees use their gift cards, or for any issues with the underlying gift card retailer.

6. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the service
• Submit false or misleading information about your organisation or employees
• Reverse engineer, copy, or redistribute any part of the platform

7. Limitation of liability

To the fullest extent permitted by law, PerkPing shall not be liable for any indirect, incidental, or consequential damages arising from use of the service. Our total liability in any calendar month shall not exceed the total fees paid by you in that month.

8. Termination

We may suspend or terminate your account if you breach these terms, fail to pay, or engage in conduct that we reasonably believe is harmful to other users or the platform.

9. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email to account administrators at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
